1. Acceptance of terms

These Terms and Conditions (“Terms”) govern your use of alabamacostestimating.com and the construction estimating, takeoff, bid preparation, consulting and related services (“Services”) provided by Alabama Cost Estimating (“we,” “us” or “our”). By using the Site or ordering Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

2. Our services

We prepare cost estimates, quantity and material takeoffs, bid packages, bid leveling, value-engineering analysis, change-order pricing, Xactimate insurance estimates and related deliverables based on documents and information you provide. A description of our services is available on our Construction Cost Estimating Services page. The scope, deliverables, price and delivery date for each project are stated in the written quote we send you.

3. Quotes, orders and payment

• Quotes are free and valid for the period stated on the quote.
• A project begins when you accept the quote in writing and, where required, pay any deposit.
• Payment terms, including any deposit or payment due on delivery, are stated in the quote or invoice.
• Late payments may delay delivery of current or future work.
• Prices do not include applicable taxes unless stated.

4. Your responsibilities

You are responsible for providing complete, legible and current drawings, specifications, addenda and project information, and for telling us your required scope and deadlines. Estimates are based only on the documents provided; missing, unclear or changed documents may affect quantities, pricing and delivery, and may require a revised quote.

5. Nature of estimates — no guarantee

Construction estimates are professional opinions of probable cost prepared from the information available at the time. Actual costs depend on market conditions, material prices, labor availability, site conditions, means and methods, design changes and other factors outside our control. We do not guarantee that bids, proposals or actual construction costs will match our estimates, and we do not guarantee that you will win any bid. You are responsible for reviewing the estimate, applying your own pricing, markup and judgment, and making all bidding and business decisions.

Our Services do not include engineering, architectural, legal, surveying, code-compliance or construction-management services unless expressly agreed in writing.

6. Revisions, changes and cancellations

Reasonable revisions for errors in our work are made at no charge. Changes caused by new addenda, revised drawings or scope changes may be quoted separately. If you cancel a project after work has started, you agree to pay for work completed up to the cancellation date.

7. Delivery

We make every reasonable effort to meet the delivery date stated in the quote. Delivery dates depend on receiving complete documents and any required deposit, and may be extended for scope changes or circumstances beyond our control.

8. Intellectual property and use of deliverables

Upon full payment, you may use the deliverables for your own business purposes related to the project. Our templates, methods, software outputs and Site content remain our property. You may not resell or redistribute our deliverables as your own estimating service without written permission. You keep all rights to the documents you provide to us.

9. Confidentiality

We treat your plans, pricing and bid information as confidential and use them only to perform the Services. You agree to treat our pricing and proprietary methods as confidential. Either party may disclose information when required by law.

10. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from the Services or the Site is limited to the amount you paid us for the specific Services giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost bids or business interruption.

11. Website use

You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or upload malicious files. Site content is provided for general information and may change without notice. Links to third-party sites are provided for convenience only.

12. Indemnification

You agree to indemnify and hold us harmless from claims, losses and expenses arising from your use of the deliverables, your bids or contracts, information you provided, or your breach of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Madison County, Alabama, and both parties consent to that jurisdiction. The parties agree to first try to resolve any dispute informally by contacting each other in writing.

14. Changes to these terms

We may update these Terms from time to time. Updated Terms take effect when posted on this page. The Terms in effect when you accept a quote apply to that project.
